TERMS OF USE

General

The following terms and conditions (henceforth referred to as the "Terms") govern all use of and orders placed on the IDAS website (www.idioidas.com) and through communication with IDAS Client Services via email or direct messaging (henceforth collectively, the "Site").

IDAS is a footwear label operated by Leo Kong, an Italian-registered sole trader (VAT: IT14080000962). These Terms form a binding agreement between you and Leo Kong (referred to "IDAS", "we", or "us").

Please read these Terms carefully before placing an order. By using the Site or placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. We reserve the right to amend the Terms at any time. The version applicable to your order is the one in effect at the time of purchase - please refer to and save that version for your records.

We do not guarantee availability of all products displayed on the Site. All orders are subject to acceptance and stock availability. Orders may only be placed by individuals aged 18 and over.

NEW: Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Milan, Italy. By using our Site, you consent to the jurisdiction and venue of such courts and waive any objection as to inconvenient forum.

Language

These Terms are published in English. In case of any discrepancy between translations, the English version shall prevail.

Intellectual Property Rights

All content on this Site, including but not limited to text, graphics, logos, images, photographs, and software, is the property of Leo Kong or its licensors and is protected by Italian and international copyright, trademark, and other intellectual property laws.

The IDAS trademark is registered in the European Union (EUTM Registration: 019142783). All photography, including works by Szilveszter Makó, remains the exclusive property of IDAS and may not be reproduced, distributed, or used without written permission.

You may not copy, reproduce, distribute, transmit, display, perform, publish, license, modify, create derivative works from, or sell any information or content obtained from this Site without our express written consent.

Placing An Order

By placing an order on the Site or through written correspondence with IDAS Client Services, you confirm that you have read and accepted these Terms.

Before finalising your purchase, you will be able to review your selections, confirm your details, and correct any errors. Please note that items in your cart are not reserved until your order is completed and confirmed via email. Inactivity or disconnection may result in loss of your cart contents.

Order Confirmation

Once you place an order, you will receive a confirmation email summarizing your order number, selected items, payment method, and delivery information. This email is a notification that we have received your order—not an acceptance of the contract.

Acceptance and Shipping Confirmation

Orders are accepted at our discretion. Once your order is processed and approved, you will receive a shipping confirmation email. Only upon sending this email is your order formally accepted and the contract concluded. Should any item be out of stock or unavailable, we will contact you directly to arrange a refund or alternative.

Product Authenticity

IDAS guarantees that all products sold through official channels are authentic IDAS products. We do not authorise the sale of IDAS products through unauthorized third parties. If you suspect you have received counterfeit goods, please contact us immediately at info@idioidas.com.

Colour Accuracy

We strive to present our products faithfully. However, due to screen calibrations, colours displayed online may differ slightly from physical items. IDAS is not liable for minor discrepancies in colour perception.

Pricing

All prices shown on the Site include VAT (where applicable). Pricing may change over time, and IDAS is not bound by prices until an order has been accepted and a shipping confirmation issued.

If a pricing error is discovered prior to acceptance, we will notify you with the correct price and offer the option to proceed or cancel. If you have already paid and the order is cancelled, we will promptly issue a refund.

Delivery fees are inclusive in the prices shown, unless specified otherwise (will vary based on destination and selected shipping method).

Made-to-Order & Personalised Items

All made-to-order or personalised items are final sale and cannot be returned, refunded, or exchanged. These pieces are created individually and intentionally for each client, honouring the unique nature of craft. Lead times may be longer than standard production. You will receive both an order confirmation and shipping notice upon acceptance and fulfilment.

For made-to-order items: You are responsible for providing accurate measurements and specifications. IDAS is not liable for sizing issues resulting from incorrect information provided by the customer. Any handling of made-to-order items beyond what is necessary to verify their nature and characteristics will result in the customer being liable for any reduction in value.

Payment Methods

We accept the following forms of payment:

• Credit & Debit Cards: Visa, Mastercard, American Express

• PayPal: Redirected securely to PayPal's platform for payment authorisation

• Bank Transfer: Where applicable, we may support direct transfer options

Payments are securely processed using industry-standard encryption and security protocols. We reserve the right to cancel any order in the event that payment authorization fails.

For returning clients, you may securely save card details for future purchases when logged into your IDAS account.

Shipping

We aim to dispatch orders within 1-2 business days. Though certain items - particularly made-to-order pieces - will require extended lead times. During seasonal peaks or holidays, dispatch may be delayed up to 7 business days.

We ship exclusively with trusted couriers such as UPS or DHL. All orders are trackable via your IDAS account or confirmation email. If we are unable to ship your order within 30 days, you are entitled to cancel your purchase and receive a full refund.

Right of Revocation (EU Consumer Rights Compliance)

For EU Customers: You have the right to revoke your order within 14 days of receiving your product without giving any reason. To exercise this right, you must inform us of your decision by sending a clear statement to info@idioidas.com.

For Non-EU Customers: You have the right to revoke your order within 14 days of receiving your product.

Exceptions: Made-to-order and personalised items cannot be returned as they are made specifically for you.

Returns & Exchanges

We offer exchanges for size (subject to availability) within 14 days of delivery. Personalised and made-to-order products are not eligible for exchange.

Returned products must be unused, in original packaging, and in the same condition as received. You are responsible for the cost of returning goods unless the item is defective or not as described.

We reserve the right to deduct from your refund any loss in value resulting from handling beyond what is necessary to assess the item's nature, quality, and function.

Return & Exchange Process

Email info@idioidas.com with your order number and reason for return.

Force Majeure

IDAS shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of natural disasters, war, terrorism, labour strikes, government actions, pandemic, or supplier delays. In such circumstances, we will notify you as soon as reasonably possible and work to minimize any impact on your order.

Limitation of Liability

To the fullest extent permitted by law:

1. Our total liability for any claim arising from your use of the Site or purchase of products shall not exceed the amount paid for the specific product giving rise to the claim.

2. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

3. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

4. Some jurisdictions do not allow limitations on certain warranties or damages, so some of the above limitations may not apply to you.
